An annulment is a legal procedure which terminates a marriage between husband and wife. Annulling a marriage basically states that the marriage never technically existed and was never valid.

Dissolution of marriage is the legal term for divorce. It primarily involves reconciling all the rights and obligations between you and your spouse, including custody and care of the minor children as well as child support and/or spousal support.

An annulment generally takes approximately 3 months where a divorce takes up to 6 months.

You MUST have grounds in order for the courts to grant an annulment. Here is a list of common grounds for an annulment:

1. Under age at time of marriage without parental consent

2. Prior existing marriage (Bigamy)

3. Unsound Mind

4. Fraud

5. Forced into marriage

6. Physical Incapacity

A common myth is that if you live with someone for seven years, then you are considered to have a common law marriage. Common law marriage is:

1. when a couple lives together for a certain number of years

2. considers themselves as husband and wife

3. have intentions of being married

Once a common law marriage is formed, that couple is treated legally the same way that traditional married couples are treated. This means that if the couple intends to no longer be married, they must file for divorce.

Common law marriage is allowed only in a few states. The following states that legally recognize a common law marriage are Colorado, Iowa, Kansas, Montana, New Hampshire, South Carolina, Texas and Utah.

Judgment creditors can garnish your wages in order to collect the judgment. Creditors of a few types of debts (back taxes, child support, and student loans) can garnish your paycheck without a judgment. In most case the maximum is 25% of your disposable income.

Garnishments to pay child support depend on whether you are currently supporting another spouse and/or child, other than the child who is the subject of the child support order. If so, up to 50% of your disposable income (what's left after mandatory deductions) can be garnished and sent to the child's other parent. If you aren't currently supporting anyone, up to 60% of your disposable income can be garnished for child support. Child Support is non-dischargeable in bankruptcy.

HOW DO I STOP A WAGE GARNISHMENT? One solution is filing a chapter 7 bankruptcy. After obtaining a filed bankruptcy copy from the court, the sheriff departments as well as your payroll department are notified of the filing. This will cease all garnishments immediately.

Well, I just celebrated 20 years of marriage (yes to the same person). Over the Last 25 years in business, I have seen my share of divorces. Most marriages seeking a divorce are under 5 years. There are numerous factors a couples files for divorce. My experience in couples seeking a divorce are financial troubles, drugs/alcohol and communication.

Over the last 20 years of marriage, we have had our share of discussions on different topics. Try raising 3 teenagers at the same time. I found it is better to UNDERSTAND than to be understood. I have to ask myself “Do I want to be right or HAPPY”. Sometimes the best thing for me to do is to keep my mouth shut. LOL

Answer: A Will is a one way ticket to probate. The worst mistake is not doing any pre-planning at all. The solution to avoid costly probate fees is having a Revocable Living Trust.

Probate is the process of transferring property to heirs after someone dies. This process is accomplished under the direction of the court. Probate can last anywhere from 6 months to 2 years before the distribution of an estate.

A Revocable Living Trust is a document which allows someone to distribute assets to heirs without the supervision of the court. Placing assets in a trust provides an orderly way to handle distribution of an estate in case of death. A trust avoids probate. Avoiding probate saves heirs lots of money and a long tedious court process that could have taken up to two years. Trustor (the person who establishes a trust) retains 100% control of an estate during their lifetime. A living trust can be amended or revoked at anytime. The establishment of a revocable living trust could be one of the biggest estate planning steps ever taken.

Once the living trust documents are signed by the Trustor, the transferring of assets into the trust is necessary. Unless this critical step is taken, the living trust may have to go through the probate process.
